Service Agreeement

This Service Agreement (“Agreement”) is entered into by and between Crestline Holiday Lighting (“Crestline,” “we,” “us,” or “our”) and the undersigned customer (“Customer”) for the installation, maintenance, and removal of holiday lighting services.

1. Deposit & Payment Terms

1.1. A non-refundable deposit of fifty percent (50%) of the total service cost is required to secure installation.
1.2. The deposit is refundable only in the event that Crestline cancels the service prior to installation.
1.3. The remaining fifty percent (50%) balance is due immediately upon completion of installation and before system activation.
1.4. Payments not received upon completion may result in removal of lighting at Crestline’s discretion.
1.5. Customer agrees to pay all costs of collection, including reasonable attorney fees, in the event of non-payment.

2. Ownership of Materials

2.1. All lighting, equipment, and materials provided by Crestline remain the sole property of Crestline, unless explicitly stated in writing.
2.2. Customer is renting the use of Crestline-owned lighting for the duration of the holiday season.
2.3. At the conclusion of the season, Crestline will remove and store the lights for future use.
2.4. Unauthorized removal, relocation, or tampering with Crestline’s materials by the Customer or any third party is strictly prohibited and may result in additional charges.

3. Installation & Removal

3.1. Crestline will professionally install holiday lighting in a safe and workmanlike manner at the Customer’s property.
3.2. Takedown is included in the service fee and will occur after the holiday season, at Crestline’s discretion, based on scheduling and weather conditions.
3.3. Customer authorizes Crestline to access their property as reasonably necessary for installation, maintenance, and removal.

4. Maintenance & Repairs

4.1. Crestline guarantees that lighting provided will remain in working condition during the display period.
4.2. If bulbs, strands, clips, or equipment fail under normal conditions, Crestline will repair or replace them at no cost to the Customer.
4.3. This guarantee does not cover damage caused by:

  • Tampering or modifications by the Customer or third parties.

  • Misuse, negligence, or intentional damage.

  • Acts of God, severe weather, or power surges.

    4.4. Repairs or replacements required due to causes outside Crestline’s control may result in additional charges.

5. Customer Responsibilities

5.1. Customer must provide safe and reasonable access to the property and ensure all work areas are clear prior to installation.
5.2. Customer must provide functioning outdoor electrical outlets protected by GFCI (ground-fault circuit interrupter).
5.3. Customer is responsible for ensuring that electrical capacity at the property is sufficient to support the lighting display. Crestline assumes no responsibility for inadequate or faulty wiring.
5.4. Customer agrees to keep landscaping (trees, bushes, etc.) trimmed as necessary to allow proper installation.

6. Scheduling & Weather

6.1. Installation dates are scheduled on a first-come, first-served basis. Crestline will make reasonable efforts to accommodate Customer preferences but does not guarantee specific dates.
6.2. Installation and takedown may be delayed due to weather, unsafe conditions, or factors outside Crestline’s control.
6.3. Crestline shall not be held liable for delays caused by weather, power outages, or unforeseen circumstances.

7. Liability & Indemnification

7.1. Crestline carries liability insurance and will take all reasonable precautions to prevent damage to property during installation and removal.
7.2. Customer acknowledges that installation/removal of holiday lighting may involve ladders, clips, fasteners, and other equipment that can potentially cause minor wear or damage to roofing, siding, stucco, paint, landscaping, or other property surfaces. By signing this Agreement, Customer accepts these risks.
7.3. Crestline shall not be responsible for:

  • Pre-existing damage to property, structures, or electrical systems.

  • Damage caused by faulty wiring, inadequate power supply, or code violations.

  • Damage resulting from acts of God (storms, wind, hail, etc.).
    7.4. Customer agrees to indemnify and hold Crestline harmless from any claims, damages, or liabilities arising out of the use of the lighting or property conditions outside Crestline’s control.

8. Termination

8.1. Either party may terminate this Agreement in writing prior to installation.
8.2. If Customer cancels after materials have been reserved, ordered, or installed, the deposit is forfeited.
8.3. If Crestline cancels, Customer’s deposit will be fully refunded.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or representations. No oral modifications are binding unless confirmed in writing and signed by both parties.
